bemypresent

Terms of use

Last updated: October 21, 2026

This is a translation provided for convenience. The Spanish version is the legally binding one and prevails in case of any discrepancy: read it in Spanish.

These terms explain how bemypresent works and what you can do with it. By creating or publishing a gift, you accept them.

1. The service

bemypresent lets you create digital gifts from templates, with your photos and your words, and share them with a link or a QR code. Whoever receives the link opens it in their browser, without an account.

2. Your account

You can create and edit a gift without an account. To publish it, you confirm your email with a one-time code; you then use that email to get to your gifts from any device. Keep access to your email safe: anyone who has it can sign in to your account.

You must be at least 14 years old, or older if the law where you live requires it. If you're younger, ask a parent or guardian to create the gift for you.

3. What you upload

What you put in a gift belongs to you and you are responsible for it. You give us permission to store it, process it (for example, resize the photos) and show it to anyone who has the link, solely to provide the service.

You may not upload:

  • illegal content, or content that incites violence, hatred or discrimination;
  • sexual content of any kind involving minors, or sexually explicit content;
  • photos or data of other people without their permission, especially of minors;
  • content that harasses, threatens or humiliates someone;
  • copyrighted material that isn't yours and that you don't have permission to use;
  • deception, scams, advertising or malicious software.

If a gift breaks these rules, we may remove it without prior notice and, if necessary, close the account. To report one, use “Report this gift” at the end of the gift or write to us at .

4. Plans and prices

  • Free: the basic templates, signed by bemypresent when it opens, and the gift is kept for at most 7 days after it's published (it may stop being visible earlier, after 24 hours, and can be recovered by upgrading until it's deleted). It can only be opened once: when the person receiving it reaches the end, it can no longer be opened again unless they keep it forever (in which case it stops expiring and is kept until you delete it or delete your account).
  • Pro: every template, no signature, and the gift can be viewed forever.
  • Premium: everything in Pro, plus protecting the gift with a question and, when available, scheduled delivery.

While payment isn't available yet, publishing Pro or Premium has no cost. Gifts you publish this way keep what they included: they won't expire or get the signature once payment starts.

When payment starts, the price of each plan will be shown before you pay, it will be paid once per gift and you'll be able to upgrade by paying the difference. Because it's digital content delivered when the gift is published, when you pay you'll be asked for your express consent to start right away and you'll accept losing the right of withdrawal.

5. How long a gift lasts

Drafts that nobody edits for 7 days are deleted automatically. A published gift stays available for as long as its plan allows: a Free-plan gift is kept for at most 7 days after it's published, unless the person receiving it keeps it forever (keeping it stops it from expiring). A Free gift can only be opened once: once it reaches the end, it can't be opened again without keeping it. You can delete your gifts whenever you like from your account: their photos and text are deleted too.

6. Writing with AI

Some templates can draft the message with artificial intelligence based on what you tell them. It's a suggestion: review it and change it before publishing. You decide what gets published and you're responsible for it.

7. Availability and liability

We do our best to keep bemypresent running at all times, but there may be outages or errors. We recommend keeping your original photos: the service isn't a backup. Except where the law says otherwise, we aren't liable for indirect damages caused by not being able to use it.

8. Changes

If we change these terms, we'll post the new version here with its date and, if the change is significant, we'll let you know by email.

9. Governing law and contact

Spanish law applies. If you're a consumer, you can go to the courts where you live. For any questions, write to us at . More information in the legal notice and the privacy policy.
